These Terms & Conditions ("Terms") govern your access to and use of the Effess website (effess.in) and platform (v1.effess.in) (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Effess is a software platform that lets businesses communicate with their customers on Meta's official WhatsApp Business Platform (Cloud API) and related channels — including conversations, broadcasts using approved templates, chatbots, automation and payments.

2. Eligibility & accounts

You must be at least 18 and authorised to act for the business you represent. You are responsible for keeping your login credentials secure and for all activity under your account.

3. WhatsApp & Meta terms

The Service relies on Meta's WhatsApp Business Platform. Your use is also subject to Meta's terms and policies, including the WhatsApp Business Messaging Policy, Meta Platform Terms and WhatsApp Business Terms. If those terms conflict with these Terms with respect to the WhatsApp channel, Meta's terms control.

4. Acceptable use

You agree that you will not, and will not allow anyone using your account to:

  • Send spam, bulk unsolicited messages, or message anyone who has not opted in to receive messages from you;
  • Use the Service in any way that violates the WhatsApp Business Messaging Policy or Meta's policies;
  • Send unlawful, deceptive, harassing, hateful or infringing content;
  • Attempt to circumvent WhatsApp's rate limits, quality system or restrictions;
  • Use the Service for any unauthorised, illegal or harmful purpose.

You are responsible for obtaining valid opt-in consent from every recipient and for the content you send. We may suspend or terminate accounts that violate these rules or Meta's policies.

5. Fees & billing

WhatsApp conversation charges are set and billed by Meta and are paid by you directly to Meta. Effess platform fees, where applicable, are described at sign-up or in your order. Fees are non-refundable except where required by law.

6. Intellectual property

Effess and its licensors own all rights in the Service and its software. You retain ownership of your content and data. You grant us a limited licence to process your content solely to provide the Service.

7. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation, or message deliverability, which depends on Meta and the recipient.

8. Limitation of liability

To the maximum extent permitted by law, Effess will not be liable for any indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid us for the Service in the 3 months before the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or Meta's policies. On termination, your right to use the Service ends and your data is handled per our Privacy Policy and Data Deletion policy.

10. Changes

We may update these Terms; material changes will be posted here with a new "Last updated" date. Continued use means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws rules.
